My take, as quoted in Business Standard, on the need and necessity of a no-contest clause in a Will:

“The increased interest comes against the backdrop of a rise in intra-family legal disputes in corporate India. While the clause has gained attention due to Tata’s will, the trend had been building. Many promoter families, apprehending potential disputes among beneficiaries that could stall the probate process, have started to incorporate this clause. It acts as a safeguard, protecting the will from being tied up in litigation. The growing complexity of family structures and the increasing number of contested wills in corporate India make such clauses more relevant.”
