In January, I had the opportunity to speak at a Kx webinar on Succession Planning, where I focused on tools such as wills, gifts, trusts, family charters, shareholders’ agreements, family settlements, and HUFs.
Part 1 of the session saw detailed discussions on:
– Wills – Drafting mechanics, probate, treatment of conflicting wills, and tax implications for executors and administrators.
– Trusts – Vesting and revocation, Section 56(2)(x), and cross-regulatory considerations under SEBI, FEMA, and the Companies Act.
Given the depth of discussion, we had kept the rest of the topics for Part 2, which was recently held. I covered this following in this session:
– Family Settlements – Taxation and Regulatory aspects especially when listed companies are involved, commercial and social aspect, valuation aspects, and treatment of brand usage and non-compete.
– Shareholders’ Agreements / Family Charters – Ownership structuring, exit rights, governance and management succession, and dispute resolution.
– HUFs – Coparcenary rights, partition, and related tax and legal issues.
